I don't agree with the statement that the FCC will not look kindly on establishing frequencies around the 49m band simply because there is pirate activity there. Let's not forget that the CB band as it exists today, unlicensed, was established primarily because the FCC could no longer control the activity there (although they would probably never publicly admit it).
I'm not saying that shortwave piracy is an overt justification for a Part 15 shortwave service. But I don't think it's a down side either (and maybe, just maybe, the FCC will infer that establishing some form of legal service there might eliminate some of the pirate activity elsewhere).
You're obviously going to have to coordinate with someone if you want to establish virtually any kind of expansion of Part 15 broadcasting, whether it be primary, secondary or what we are now kind of use. That will be the difficult part. Otherwise, you're stuck with the existing AM & FM bands, and tweaking Part 15 to make it slightly better than it is today. Or in the case of shortwave, tweaking use in the ISM bands.
